1. Introduction

This service named Sakeist is managed by Khariis Co., Ltd, an international online platform operator registered in Daiwa Azabu Terrase 5F, 3-20-1, Minamiazabu, Minato-ku, Tokyo, 1060047, Japan (“Khariis”, “we” or “us”). This service can be access through our mobile application (“App”) and/or our website “https://khariis.com/“.

Please read these terms of use carefully before using the services offered by App and/or Website (collectively “Platform”). These terms of use set forth the legally binding terms and conditions for your use of Platform.

2. Acceptance of the Terms

These general terms and conditions (“Terms”) apply between Khariis and all use of Platform. By using the functionalities of Khariis’s Platform, a person using this service understands and agrees with the terms and conditions described in the Terms and our Privacy Policy described in Platform.

We may vary the content of Terms from time to time. If you continue to use Platform, you are deemed to have accepted such variations. If you do not agree to such variations, you should not to use Platform.

3. Use of Application

Kharriis provides a service that enables registered User to review sake comments and sake information and to follow other Users to see their ongoing reviews. Users submitted to the Platform will be introduced to the various of reviews on sakes based on criteria provided by the User, and the User can review sake ratings.

In order to gain access to the functionalities of the Platform, the User has to sign up and register as a User of the Platform. When registering via our online Platform, the User provide us with certain information. When registering and signing in via third-party application login (such as Facebook), the User authorize us to access certain account information from that third-party application. The usage of the personal information of the User collected during the registration are described in our Privacy Policy.

The Platform is intended for use by adults of legal drinking age in the jurisdiction in which you reside. In the event that the User is under the legal drinking age, we will be entitled to terminate the account and delete all personal information that has been provided to us.

The User is encouraged not to reveal personal data concerning the user itself and other especially special categories of data (such as information about a person’s health, addictions or allergies) when commenting on sakes or reviews, nor when uploading pictures on the Platform. When a User makes such information about them or others public, the User is responsible for ensuring legal ground for disclosing the information. The User is solely responsible for any content of reviews, posting pictures and information made available on the Platform and the public.

4. Prohibited Use

You agree not to:

1. use Platform that is unlawful, illegal or unauthorized under the laws and regulations of the territory from which the Platform is accessed or used;
2. provide Khariis with incorrect account information including name, address and e-mail address:
3. defame, harass, abuse, threaten or defraud any other person (including users of Platform);
4. collect or attempt to collect personal information of any other person, including users of Platform without his/her consent;
5. use Khariis’s service(s) for any commercial purpose without our consent;
6. infringe intellectual property (including copyright, trademark, patent and data protection and privacy) of any other person, including users of Platform;
7. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; or
8. reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of Platform (including App).

5. Duration, Termination and Modification

These Terms are in force for as long as the Users account is active. If the User violates one of the prohibited behavior described in the Terms including Article 4, Khariis is entitled to terminate a user account immediately. Khariis’s rights to user content shall not be affected by the termination of the Terms or a user account. Termination of a user account does not relieve you from any obligation under any other agreement that has not been specifically terminated.

Khariis reserves the right to modify, suspend or close the Platform at any time without notice to the User. Khariis will have no liability whatsoever on account of any change to the Platform, any suspension or revocation of the access of the Platform.

6. Intellectual Property Rights

Intellectual property rights concerning trademark, logos, graphics, software and contents (collectively “Contents”) in connection with the Platform belongs to Khariis, and are protected by relevant laws and regulations concerning intellectual property rights.

Contents in connection with the Platform cannot be copied, modified, distributed beyond private use and the scope explicitly permitted by the laws and regulations of the territory from which the Platform is accessed or used, unless prior consent is obtained from Khariis.

7. Disclaimer of Warranty

The Platform is provided “as is” and “as available” basis, without warranty or condition of any kind, either express or implied. Specifically, Khariis does not warrant or make any representation regarding validity, accuracy, reliability, non-infringing or availability of the Platform or its content.

You assume the risk for damage to your computer system, mobile device or loss of data that may result from your user of or access to Platform. Any content, materials, information or software downloaded or used through the use of the Platform is done at your own discretion and risk.

8. Limitation of Liability

To the maximum extent permitted under applicable law, in no event shall Khariis be liable to the User with respect to use of the Platform and/or be liable for any direct, indirect, special, consequential or punitive damages, whether based on warranty, contract, tort (including negligence), statute or other legal theory, whether or not Khariis have been informed of the possibility of such damage results from your access to or use of, or inability to access or use the Platform.

In the event that applicable law does not allow exclusion of certain promised and/or exclusion of liability for direct, indirect, consequential or other damages, in no event shall Khariis‘s liability arising under or in connection with the Platform exceed USD $1.00.

9. Miscellaneous

If a clause in the Terms is not enforceable, the unenforceability of that clause will not affect any other sections of the Terms.

These Terms and any disputes arising hereof, or other disputes or claims arising out of or in connection with the use of the Platform shall be settled in accordance with Japanese law by Tokyo District Court or Tokyo Summary Court, Japan.

These Terms may from time to time be amended at Khariis’s sole discretion, followed by a notification to the Users. Users are bound by any changes to the Terms when using the Platform after changes have been posted. An updated version of the Terms will at all-time be available in the Platform.
